Terms of Service
1. Acceptance of Terms
By creating an account, purchasing a subscription, or using Check-ly, you agree to these Terms and our Privacy Policy.
2. Accounts and Use of the Service
- You must provide accurate account information and keep it up to date.
- You are responsible for safeguarding your login credentials and activity under your account.
- You may not misuse the service, interfere with its operation, or submit fraudulent attendance records.
3. Fees and Payment
Subscription Plans
- Monthly subscription: Auto-renews monthly at the regular monthly rate.
- Annual subscription: One-time payment for 12 months at a discounted rate.
Auto-Renewal
All subscriptions automatically renew at the end of each billing period unless cancelled. We charge the payment method on file at each renewal.
Cancellation
- Cancel anytime via Settings → Billing.
- Service continues until the end of the current billing period.
- No prorated refunds for unused time on annual subscriptions.
Price Changes
- We may publish new prices and plan limits for new contracts without advance individual notice. The terms shown and accepted at purchase apply. Renewals and recurring payments under existing contracts are not new contracts.
- For increases to existing subscriptions, we explain the old and new prices, effective date and cancellation options in advance and obtain any required consent within the period required by applicable law and the contract. We also follow the merchant of record's applicable procedures. We do not charge an increase without required consent or override an agreed fixed-term price.
- Promotional terms such as free trials, beta features and the early partner program may be changed or ended at any time by posting notice, but any free period already started will be honoured for its promised duration.
4. Intellectual Property
All software, content, trademarks, and related materials made available through Check-ly remain the property of Jone Labs Inc. or its licensors.
5. Changes to the Service and to These Terms
We may make interface improvements, bug fixes, and performance or security improvements without advance individual notice where contractual rights and obligations are not materially affected. Adverse changes to promised core features follow the procedure below.
- Corrections that do not substantively change your rights or obligations may take effect when posted.
- For adverse or substantive changes to existing contracts, we publish the changes, reasons and effective date and notify affected members by email or another appropriate means, allowing reasonable time to decide whether to continue. Notice periods and methods required by applicable law or the existing contract take precedence.
- Where consent is required, we obtain it before applying the change. Posting or silence alone does not replace required consent, and changes do not retroactively reduce accrued rights.
- If you do not agree to a change, you may terminate your subscription before its effective date, and we will not charge any additional fee for doing so.
6. Disclaimer and Limitation of Liability
To the maximum extent permitted by law, the service is provided "as is" and "as available." We are not liable for indirect, incidental, special, consequential, or punitive damages.
7. Termination
We may suspend or terminate your access if you violate these Terms, misuse the service, or fail to pay applicable fees.
8. Governing Law and Contact
These Terms are governed by the laws of the Republic of Korea. Where the mandatory consumer protection law of your country of residence grants you rights that cannot be waived by agreement, those provisions prevail over these Terms.
